Mr Trump invoked the same powers he used to impose a travel ban on Muslims that was upheld by the Supreme Court in June.

Before the mid-terms, President Trump frequently denounced a caravan of thousands of Central Americans making their way north through Mexico.

"The vast majority of aliens who enter illegally today come from the Northern Triangle countries", the regulation's text reads.

He called a current caravan, which is still hundreds of miles from the United States border and dwindling in numbers, an "invasion" and said it would bring hardened criminals to U.S. streets.

"US law specifically allows individuals to apply for asylum whether or not they are at a port of entry".

The asylum section of the Immigration and Nationality Act says a migrant is allowed to make a claim up to a year after arriving in the USA, and it doesn't matter how they arrive - illegally or through a border crossing.

U.S. law gave migrants seeking asylum a legal obligation to have their claims heard if they feared violence.

The US president railed against the caravan in the lead up to the election, telling the refugees and migrants they would not be welcomed in the United States. A US asylum officer then conducts an interview to determine if the person has a "credible fear" of persecution, in which case the applicant is typically assigned a court date and released from custody.

The rule adds that immigrants who entered before the proclamation "will not be subject to the asylum eligibility bar unless they depart and reenter while the proclamation remains in effect".




A number of lower courts had originally deemed the measure unconstitutional.

That status does not give foreigners a path to a green card or citizenship, and instead functions as a kind of provisional suspension of the deportation process, revocable at any time. "It is illegal to circumvent that by agency or presidential decree", said Omar Jadwat, director of the ACLU's Immigrants' Rights Project.

Sessions, who resigned at Trump's request this week, also instructed immigration judges and asylum officers to view illegal border-crossing as a "serious adverse factor" in deciding a case and to consider whether applicants could have escaped danger by relocating within their own countries.

Trump said he was sending 15,000 active duty military to the border to deal with the problem, in what former President Barack Obama called a political 'stunt.' The troops began laying barbed wire as the migrants traveled toward the US on foot.

The president can stop migration in the "national interest", a statement said. "They clearly and explicitly meant to make asylum available to anyone who reaches the United States".

The unanimous decision by a three-judge panel of the U.S. Court of Appeals for the 9th Circuit increases the likelihood that the fate of almost 700,000 "dreamers" will be settled by the Supreme Court.

It forms one part of the president's latest efforts to tighten border security and clamp down on immigration.

The new changes were likely to be met with legal challenges, too.
