Charges Dismissed Against Suspects in 'Extremist Muslim' New Mexico Compound Case

District Judge Emilio Chavez dismissed all charges against three of the five "extremist Muslims" connected to the New Mexico compound on Wednesday, claiming that prosecutors did not move fast enough in the case according to the state's laws.

A judge says the district attorney missed a crucial deadline to justify the child neglect charges and he was forced to drop the allegations and free the three.

The 11 counts of felony child abuse against Hujrah Wahhaj, Subhannah Wahhaj, and Lucas Morten were dismissed because a judge ruled they didn't have a preliminary hearing in the 10-day time frame required by New Mexico state law for defendants in custody, a state courts official told CNN.

Some conservatives are calling conspiracy after child abuse charges against three individuals suspected of training children for school shootings at a New Mexico compound were dropped over procedural errors.

Taos-based District Attorney Donald Gallegos announced on social media Thursday that his office will refile charges or take the case to a grand jury.

Prosecutors offered no immediate indications Wednesday as to how they will proceed.




Defence lawyers say their clients have no record of criminal convictions and pose no risk to the public.

But authorities later pushed ahead with new charges of child abuse resulting in death against the dead boy's father and mother, Siraj Ibn Wahhaj and his partner Jany Leveille.

Three days later, Abdul-Ghani's body was found buried under human waste in a tunnel under the compound; his remains were discovered on what should have been his fourth birthday.

Another hearing for Siraj Wahhaj, the father of the 3-year-old boy who was discovered dead on the property, will take place Wednesday afternoon. They are accused of child abuse resulting in death.

Ibn Wahhaj and Laveille, who were members of the compound, remain in custody facing separate charges for taking the brain-damaged toddler from his biological mother in Georgia and allegedly causing his death on December 24 by denying him anti-seizure medicine.

The boy's mother initially reported the boy missing a year ago from Jonesboro, Georgia, after Siraj Ibn Wahhaj said he was taking the child to a park and didn't return.

The outlet reported that prosecutors said they found a handwritten document called "Phases of a Terrorist Attack" at the compound. Forensic medical investigators have not yet identified the cause and manner of the boy's death.
