On Monday, 49ers general manager John Lynch said that Foster won't be a part of the team if the domestic violence charges against him are "proven true", which means they're not cutting him exclusively based on the accusations and charges that have been brought against him.

The San Francisco won't cut linebacker Reuben Foster until the legal process plays out. However, this offseason, he has been arrested on a couple of occasions, one for a serious charge of domestic violence. "Adds no one is bigger than team". Lynch stressed on Monday, however, that if indeed Foster is convicted on the domestic violence charge, he will no longer be part of the organization.

"The gravity of these charges has not been lost us", Lynch said. That's the standard we want on our team.

In addition to the criminal charges, Foster is subject to potential NFL discipline under the league's personal conduct policy, which mandates a six-game suspension for a first-time domestic violence offense. "We do feel like patience is the right approach right now", Lynch said. We're gonna learn things through this legal process.




"We miss his spirit a lot", linebacker Malcolm Smith said.

Foster has been accused of dragging his girlfriend and punching her in the head, rupturing her eardrum. "But again we felt after we sat back after that and took account of what happened, we felt there's still reason to wait, and that's what we're doing".

So there's that. But we just wonder if this would be the case under different circumstances.

The 49ers traded up to pick No. 31 in last year's draft to take Foster, widely considered a top-10 talent, despite numerous off-the-field issues, including injury concerns, a failed drug test at the combine and getting kicked out of the combine for getting into an altercation with a hospital working while awaiting a physical.
